特殊支配同族会社の役員給与損金不算入について（１）
25 10 2006平成１８年４月１日以降に開始する事業年度より、一定の要件に該当する同族会社（以下「特殊支配同族会社」という）の代表者（以下「業務主宰役員」という）の役員報酬に係る給与所得控除額が、その法人の所得の計算上、損金不算入となります。
業務主宰役員とは
法人の代表者として申告書に自署押印している者や、最高額の役員報酬額を受取っている者が該当すると考えられます。
特殊支配同族会社に該当する要件
その事業年度末までに次の①及び②の要件に該当する場合には、（一定の適用対象外法人に該当する場合を除き）特殊支配同族会社に該当することとなります。
① ９０％基準
業務主宰役員グループ（※１）がその同族会社の発行済み株式（自己株式除く）の９０％以上の株式を保有している事もしくは議決権（解散や株式交換などの組織再編、役員の解選任、役員報酬、利益配当に関する決議）付株式をその総数の９０％以上保有している事
（※１）業務主宰役員とその親族等及びこれらの者が支配する会社をいいます
